Power Law is delighted by Friday’s ruling of the Supreme Court of Canada in Société de l’Acadie du Nouveau-Brunswick v Canada (Prime Minister). The Court held that the appointment of a Lieutenant Governor in New Brunswick who does not have the ability to understand both official languages and to communicate in these languages when performing their functions infringes s 16(2) of the Charter. The Supreme Court of Canada reinstated the first instance decision of the Court of King’s Bench, a case won by Power Law acting for the plaintiff, the Société de l’Acadie du Nouveau-Brunswick. Before the Supreme Court of Canada, Power Law represented the intervener, the Association des juristes d’expression française du Nouveau-Brunswick.
